Do I Need A Real Estate Lawyer?

  • Are you buying or selling property on an owner-finance? Land contract? 
  • Do you own or manage income-producing property?
  • Are you concerned about your property rights?

In a typical real estate transaction, who has YOUR interests at heart?

  • The real estate brokers and agents? No, their primary motivation is to close your deal and move on to the next one. They do not get paid unless that sale closes. 
  • The lenders? No, their interest is in making sure you will pay off the loan, while charging many fees and points, and at the highest interest rate possible.  
  • The title company? Not really. Their focus is to ensure that the title is clear, and there will be no claims against them in the future. (Did you know that any easements of record are excluded from coverage? Do you know if the property you’re buying has an easement or encroachment of record that would not be covered?)
  • The property inspector? You can choose the inspector, but most of them depend on real estate professionals for future referrals, so who do they really answer to?  State law limits inspectors’ liability to the amount you paid for the inspection – usually about $400. So, even if they miss something, you practically cannot sue them. 
  • The contractor, if construction or repairs are involved? Not at all. Construction companies protect their own bottom line, as you’d expect them to do.

If no one at the table is on your side, then it’s just you.

Most of the time, you are the only one in the transaction who really cares about protecting your end of the deal. Everybody else may be friendly and helpful, but it comes down to you.
